There also are a large number of American businesses incorporated in Bermuda, although no actual figures are available. Despite the trend of American businesses moving to Bermuda or other offshore jurisdictions to escape U.S. taxes, Bermuda maintains that the island is not a "tax haven" and that it taxes both local and foreign businesses equally. ...

Bermuda enacted the Investment Business Act (IBA) in 1998 to regulate the island's financial services industry. In response to international directives, the government passed the Investment Business Act 2003 to further refine its terms. The act creates a balance between government regulation on the one hand and the competitive needs of Bermuda's most important industry--international business--on the other hand. By updating its regulatory framework, Bermuda has enhanced its reputation globally as an international standard-bearer. The number of flights servicing Bermuda increased in 2004 following government efforts to improve tourist access to the island. Daily flights are available between Bermuda and a number of US cities, including New York, Newark, Baltimore, Washington, Philadelphia, Boston, Atlanta, and Charlotte.  Seasonal flights operate to Chicago, Orlando, Ft. Lauderdale and Halifax. Good non-stop services also connect Bermuda with London five days a week and Toronto daily. Washington National and Baltimore-Washington International Airports are about 2 hours away by direct flight. Passengers on the many flights to the US are pre-cleared by US Customs and Border Protection officials at Bermuda's airport, arriving at domestic terminals on the mainland. Visa Waiver Program (VWP)

The Enhanced Border Security and Visa Entry Reform Act created a requirement that VWP travelers present machine-readable passports (MRP), which are tamper-resistant and incorporate biometric identifiers in compliance with guidelines established by the International Civil Aviation Organization. This legislation, which required VWP travelers to present a passport, which included certain biometric identifiers, originally had an October 26, 2004 deadline.
