In the case of shipping income, the proposed new treaty provides for exclusive residence-country taxation of profits from the operation in international traffic of ships or aircraft. This elimination of source-country tax covers profits from the rental of ships and aircraft on a full basis; it also covers profits from rentals on a bareboat basis if the rental income is incidental to profits from the operation of ships or aircraft in international traffic. Rental car agencies provide roadside assistance to their clients as a condition of the rental contract. Cuban authorities may prohibit drivers of rental cars who are involved in accidents from leaving the country, even if they are injured and require medical evacuation, until all claims associated with an accident are settled.
