Wis.LIRC UC Decision: Klein, Robert, et al. - February 27, 1990 - AA 126.4 - Voluntary LOA for a definite period - "Voluntariness" of leave - scheduled plant shutdowns; UW 910 - Allocation of dismissal, holiday, vacation pay - employees out of work during 2-wk scheduled shutdown were neither on vacation nor on voluntary leave of absence - CBA provided employees could use accrued paid vacation entitlement during the shutdown, but employer had allowed some employees to use up their vacation before the shutdown - whether these employees were on "voluntary" LOA during the shutdown is not to be determined by the union contract, but by the dept.
The present controversy results from a different collective bargaining agreement, negotiated in 1987, and first applicable to shutdowns which occurred in 1988. During negotiations, the employer sought to obtain a provision which would permit the employer to designate a second week, during the employer's "Christmas shutdown," as a week of mandatory vacation. The union wanted some flexibility in any such provision and the compromise ultimately reached was that the employer could designate Christmas week as a vacation shutdown but it would not be mandatory that employes use vacation during that period; however, the employer obtained a provision which effectively required that employes who did not save a week of vacation for Christmas week but chose, instead, to use up their vacation earlier in the year would be considered (by the parties to the collective bargaining agreement) to be on a "personal leave of absence" in Christmas week and therefore ineligible for U. Ct., Dane Co., December 17, 1990) - AA 126.4 - Voluntary LOA for a definite period - "Voluntariness" of leave - scheduled plant shutdown - when CBA granting paid vacation also provides for shutdown week during which employes may use their vacation, employes not paid in that week because they are not using their paid vacation time are not disqualified from receiving benefits on the theory that they are on a "voluntary leave of absence" just because because they agreed through their union to such or because they had the choice of saving their vacation pay to use in that week
Employes were entitled to two weeks paid vacation. The collective bargaining agreement (CBA) allowed the employer to designate a week of plant shut-down in the summer as a period in which one week of this vacation entitlement had to be taken. Employes were allowed to take their second week of vacation when they chose. However, the CBA also provided that there would be another week of plant shutdown in Christmas week, and that employes who did not save their other week of vacation for this period would be deemed to be on a "personal leave of absence" that week. Some employes took their vacation at other times, had no paid vacation entitlement for the Christmas week, and sought benefits for that week, which the department allowed.  The employer argued that the employes were ineligible because they were on a "voluntary leave of absence" within the meaning of section 108.04 (1)(b)2. during the week in question.
