This is because the Employee Retirement Income Security Act (ERISA) may preempt state-enacted protections. That is why the President has called on Congress to pass a federally enforceable patients’ bill of rights so that everyone enrolled in managed care may have a basic set of protections. Notably, 350,000 West Virginia women are in ERISA health plans and are therefore not necessarily protected.
