The Charitable Trusts Unit implements the Attorney General's statutory and common law responsibilities to represent the public interest with respect to charities and to enforce the proper administration of charitable trusts in Rhode Island. ( R.I. Gen. L. § 18-9-1, et seq. ) The Attorney General must be provided with notice with respect to all court proceedings which affect charitable trusts in the state of Rhode Island. Such matters may include cy-pres proceedings, petitions to amend charitable trusts, petitions to amend the articles of organization or by-laws of a non-profit corporation, and other cases of equity. The Administrator of the Charitable Trusts Unit reviews all such matters and participates in petitions and other litigation. The Attorney General is established under the Rhode Island Constitution as one of the five general officers subject to election by voters. The office of the Attorney General was first created in Rhode Island in May 1650. Since its creation, the office has been an elected position, except for a brief period from 1740 to 1742 when the charter allowed for the appointment of a King's attorney for each county. The office of the Attorney General was formally adopted under the Rhode Island Constitution in 1842. While other States, except Delaware, have district attorneys who prosecute criminal cases, Rhode Island assigns that duty principally to the Attorney General. Under existing law, any person denied the right to inspect a public record may file a complaint with the Department of Attorney General.
