"Latina" is a funny word It was hard for me to choose who I wanted to be. Living in a predominantly black community, I had not even met another Hispanic until the 8th grade. Even so, I always had an eclectic group of friends, ranging from Filipinos to African Americans to Pakistanis. Since I was a child, my mother had taught me Spanish and the customs associated with my Puerto-Rican heritage. There was never a question whether I was proud to be “boricua.” How many people do you know that listen to “Campanitas de Cristal” in the morning and move their “bon bon” to “Jailhouse Rock” in the afternoon? I grew up loving baseball, salsa, and coquito. When people asked me whom my hero was I’d answer “Roberto Clemente", and they would stare at me for a few seconds and I would have to give an explanation (first Hispanic baseball player elected into Hall of Fame; Puerto Rican). When geography projects rolled around I would always try to get Puerto Rico. I w ... [Read More]

USCA1 Opinion 04-2610 In order to stave off the need for mandamus, we invitedthe District Court to address these mandamus petitions. Inresponse, the court appended a footnote to the opinion ofNovember 30, 2004 in which the District Court asserted jurisdictionover the parallel federal case. Pedro Rosselló, et al. v. Sila M.Calderón, et al. , No. 04-2251, slip op. at 3, n.2 (D.P.R. Nov. 30,2004). The footnote indicated that a hearing was needed toproperly evaluate the jurisdictional issues raised in the pendingmotions to remand. Specifically, the District Court indicated: (1) that the Suárez Plaintiffs' complaint had alleged violations ofdue process and equal protection without specifying whether thesource of these protections was the Commonwealth or FederalConstitution; (2) that federal jurisdiction might be required under Franchise Tax Board v. Construction Laborers Vacation Trust , 463U.S. 1, 22 (1983); and finally, (3) that the legal interests ofsome Suárez Defendant ... [Read More]
