Lawyer In Puerto Rico

USCA1 Opinion 03-1621
After an evidentiary hearing, the district court enteredan order "declaring the requirement . . . that petitions for newpolitical parties be notarized by a lawyer to be in violation ofthe First Amendment of the Constitution." Pérez Guzmán , 260 F.Supp. 2d at 394. The court's determination rested in large part onthe idiosyncratic nature of Puerto Rico's lawyer-notarizationrequirement. In that regard, the court made three criticalfindings. First, it found as a fact that the cost of notarizing100,000 petitions would be at least $1,500,000. Given thissubstantial outlay, the lawyer-notarization requirement imposed asevere financial burden upon a citizen's "right to associate and toform political organizations which advance common goals andideals." Id. at 392 (footnote omitted). Second, the court foundthat the appellants had failed to show that the lawyer-notarizationrequirement was narrowly tailored to advance a compellinggovernmental interest. Id. at 393. In making thi ... Yet amidst the vibrant colored picture of the island’s most marketable attributes is a darker reality. Traveling inland into the modest communities where most natives reside reveals a more sobering picture: that of a people struggling with the day-to-day problems of poverty. Despite the rambunctious demeanor of a citizenry always ready for a festival (there are more than 500 a year here), life on the island is no tropical paradise for many of Puerto Rico’s 3.8 million inhabitants. Forty-five percent, or roughly 1.8 million people, live at or below the poverty line. The unemployment rate, which has not dipped below double digits in this millennium, currently hovers above 11 percent. By some estimates, as many as 100,000 Puerto Ricans are homeless, living on the streets and in the island’s cramped shelters. The drastic change in scenery can be an eye-opener for tourists and the small, elite circle of island residents with the disposable income to buy expensive cars, high-end second homes ... Lawyers
Lawyers held about 695,000 jobs in 2002. About 3 out of 4 lawyers practiced privately, either in law firms or in solo practices. Most of the remaining lawyers held positions in government and with corporations and nonprofit organizations. For those working in government, the greatest number were employed at the local level. In the Federal Government, lawyers work for many different agencies, but are concentrated in the Departments of Justice, Treasury, and Defense. For those working outside of government, lawyers are employed as house counsel by public utilities, banks, insurance companies, real-estate agencies, manufacturing firms, and other business firms and nonprofit organizations. Some salaried lawyers also have part-time independent practices; others work part time as lawyers and full time in another occupation. ... [Read More]
