A bankruptcy court order denying a motion for remand of a state court action was REVERSED and REMANDED. The Court's appellate jurisdiction is not barred under 28 U.S.C.§ 1334(c) or 1452(b), and order of the bankruptcy court denying remand was a "final order" under the collateral order doctrine or an appealable interlocutory order under 28 U.S.C.§ 158(a)(3).  The bankruptcy court's jurisdiction over the state court action was at most "related to" the debtor's Chapter 11 case under 28 U.S.C.§ 157. The bankruptcy court was required to abstain from hearing the state court action under 28 U.S.C.§ 1334(c)(2). Once the Aircraft Registration Branch records the security agreement, it will return to the secured party a Conveyance Recordation Notice, AC Form 8050-41. This notice describes the aircraft (and engines, propellers and locations if included), lists the parties and date of the security agreement, and shows the FAA recording number and date of recordation.
