Ohio Supreme Court case on confidentiality In 1988, relator, Tom Schneider ("Schneider"), married Theresa Schneider. They had two children. In 1994, the Schneiders divorced and entered into a shared parenting agreement. Subsequently, criminal charges were filed against Schneider for violating the agreement. A Review of the Disability Decisions of the United States Supreme Court's 2001 Term The opinions in Barnes are interesting because they reflect a larger dispute within the Court about the authority of the Congress to allow suits against the states for money damages. These so called "federalism" concerns resulted in the Garrett decision of the 2000 term, ruling that Congress could not authorize suit against the states for damages under Title I of the ADA without violating the 11th Amendment to the U.S. Constitution. Other questions like those in Garrett are working their way up to the Court. The Court declined to review the case of Ohio EPA v Nihiser, in which the Sixth Circuit said that states can be sued for damages under §504 because they had waived immunity by taking federal money. The Court also declined to review Popovich v. Cuyahoga County Common Pleas Court, where the appeals court said the state could be sued for money under Title II of the ADA for denial of meaningful access to a court proceeding.
