North Carolina State Bar Opinions Restricting Involvement of Non-Attorneys in RealEstate Closings and Refinancing Transactions
The United States Department of Justice and the Federal Trade Commission write to urge the Committee's reconsideration of two opinions relating to the involvement of non-attorneys in closing real estate refinancing and purchase loans, Opinions 2001-4 and 2001-8. Opinion 2001-4 requires the physical presence of attorneys at all refinancings of residential real estate deals. Opinion 2001-8 requires their presence at the closing conference for real estate purchases. Based on other states' experience, these opinions are likely to increase closing costs and increase inconvenience for North Carolina consumers. We also understand that the Committee is considering adopting an omnibus opinion that would clarify certain situations in which the Opinions do not apply, and we offer comments on the proposed clarifications. ... Search for the "Cittie Of Ralegh" The "Cittie of Ralegh" is the name of the settlement that the 1587 colonists planned to create on the shores of Chesapeake Bay. The only known site actually inhabited by the planters is the vicinity of the settlement built in 1585 by the Ralph Lane Colony on the north end of Roanoke Island, North Carolina. This area has traditionally been identified as the location of the "Cittie of Ralegh," but no one knows whether the "Cittie" was ever more than a legal entity. Archaeological investigations in the area have resulted in the reconstruction of an earthen structure similar to the sconce Ralph Lane is known to have built in Puerto Rico in 1585 en route to Roanoke Island. (It also resembles the octagonal bastion built in Maine by Popham in 1607.) St. Mary’s College , founded in 1842 by the Episcopal Church, is the oldest continuously operating school in Raleigh and the third oldest school for girls in North Carolina. The Peace Institute was incorporated in 1858 as a Presbyterian-affiliated school for young women. One of the earliest public education facilities in Raleigh was the N.C. School for the Blind and Deaf (1848). An agricultural and industrial college, the N.C. Agriculture Experiment Station, was founded in 1877. Contacts reported that their clients remained hesitant to commit to real estate deals in the sluggish economy--a realtor in the Raleigh, North Carolina, area told us firms there had "no sense of urgency" to obtain additional space. The retail sector was one of the bright spots in recent weeks; retail vacancies remained low and rents held firm. "We are very upbeat [about retail]…things are headed in the right direction," remarked a realtor in Bristol, Virginia. In contrast, office leasing activity was slow and vacancy rates remained high.
