[3] Lawyers often receive funds from third parties from which the lawyer's fee will be paid. If there is risk that the client may divert the funds without paying the fee, the lawyer is not required to remit the portion from which the fee is to be paid. However, a lawyer may not hold funds to coerce a client into accepting the lawyer's contention. The disputed portion of the funds must be kept in trust and the lawyer should suggest means for prompt resolution of the dispute, such as arbitration. Holmes Conrad , Solicitor General
William DeWitt Mitchell, son of William, a lawyer who eventually became a state supreme court justice, and Frances Merritt Mitchell, was born in Winona, Minnesota on September 9, 1874. Mitchell received his early schooling in Winona Schools and the Lawrenceville School of New Jersey before enrolling in the Sheffield Scientific School at Yale University in 1891. Though he originally entered Yale with an interest in electrical engineering, after two years his focus shifted to law and he subsequently transferred to the University of Minnesota. To make up for lost time, Mitchell simultaneously took law courses at night while finishing his undergraduate degree. In 1895, he earned his bachelor’s degree, followed by his law degree and admission to the bar in 1896.
