Streamlined Sales and Use Tax Agreement: States' Efforts to Facilitate Sales Tax Collection From Remote Vendors
I realize that many state tax officials hail the Streamlined Sales and Use Tax Agreement (''SSTA'') as an epochal event in sales and use tax reform. The reality, however, bears little similarity to the hyperbole. The truth is that the Streamlined Sales Tax Project (''SSTP'' or ''Project'') has woefully failed to fulfill its original goal of simplifying and harmonizing the existing morass of state and local sales and use tax laws. Indeed, the representatives of the states participating in the Project have, at every critical juncture, turned away from real and substantive tax reform in order to cling to the many diverse and unique features of their individual state tax systems. It is this disparity in state and local sales taxes that makes the existing tax regime so ill-suited to interstate commerce. The Streamlined Sales and Use Tax Agreement, in its current form, falls far short of its professed objective of simplifying state taxes and, to the contrary, in many ... [Read More]

FRB: Beige Book - Full report
Manufacturing activity grew faster at most firms. Electrical and electronic firms reported accelerated sales growth which "exceeded expectations," boosted by strong sales of wireless products and personal computers. Most chip fabrication plants were running at close to full capacity. Petrochemical sales were boosted by strong demand in the U.S. and Asia. Sales of cement, concrete, brick, paper products, fabricated metals and most apparel products were up slightly in the past six weeks. A fabricated metals producer worried that sales were inflated by Y2K-related buildups in customer inventories, while a lumber producer said that Y2K concerns may have caused customers to delay purchases until the new year. Sales of lumber and food products were steady. Warm weather dampened sales of fleece-lined apparel. Primary metals producers reported weaker sales--possibly due to large customer inventories. Glass product sales declined, and refinery activity slowed. ... [Read More]

Internet Tax Nondiscrimination Act
TOP OF DOC      Discriminatory Taxes. Sections 1104(2) (A) (iii) and 2(B) (ii) (II) of the1998 Internet Tax Freedom Act and its successor, the Internet Tax Nondiscrimination Act, are components of the definition a discriminatory tax. In its entirety, the definition was intended to protect on-line retailers from unfair taxation by states and localities so that e-commerce would receive same tax treatment as all other forms of remote commerce. Read together, the interplay between these two provisions could have another, unintended effect by encouraging brick and mortar retailers to engage in sophisticated tax planning strategies that will allow them to escape the responsibility to collect sales tax on sales made in those states where they otherwise have clear sales tax nexus. Across the nation, large brick and mortar retailers with nexus in various states have attempted to escape sales tax collection on in-state sales by creating a separate, out-of-state Internet-bas ... Philadelphia and New York City are the primary distribution centers for cocaine distributed at the wholesale level in Pennsylvania. In eastern Pennsylvania, Philadelphia-based Colombian DTOs operate at the highest level and are the primary wholesale cocaine distributors. Dominican DTOs operate at the wholesale and midlevel, and sometimes act as midlevel street sales managers, controlling street corners, stash houses, and employing and supplying the street-level workers who sell directly to the customers. Mexican criminal groups reportedly are attempting to increase their share of the wholesale cocaine market in eastern Pennsylvania and elsewhere on the East Coast, according to the Philadelphia/Camden High Intensity Drug Trafficking Area (HIDTA). ...
