A motion for summary disposition may be based on one or more of several grounds listed in MCR 2.116(C). : GN 00305.165 - Summary of State Laws on Divorce and Remarriage - 05/10/2001 Effective 3/1/79, there are no restrictions against remarriage following a divorce decree. A divorce decree is now final for all purposes when it is entered. This rule is subject to two exceptions: (1) If it has been contested in the divorce proceedings that the marriage is irretrievably broken (effective 3/1/79, this is the single ground for divorce), neither party may remarry before the time for appeal has expired. The appeal period is ninety days following entry of the decree. If the divorce proceeding is uncontested as to the grounds for divorce, either party may remarry before the time for appeal has expired. (2) If either party appeals the divorce decree on the ground that the other party is not entitled to a divorce, neither party may remarry pending disposition of the appeal. Unless there is evidence in file to the contrary, assume that neither of the exceptions applies and that both parties were free to marry before the expiration of the appeal period.
