The Indiana Securities Division of the Indiana Secretary of State's Office enforces the Indiana Loan Broker Act (IC '23-2-5; "the Act"). This state law regulates loan brokers doing business in Indiana. Loan brokers, including mortgage brokers, bring together borrowers and lenders for a fee, collected at the closing of the loan. The vast majority of loan brokers doing business in Indiana are mortgage brokers. Two-thirds of residential mortgage loans are now originated through mortgage brokers. Most mortgage brokers represent between 10 and 70 lenders. These lenders all loan on different terms and have different underwriting guidelines. The purpose of this brochure is to alert you to common problems in using loan brokers; provide you with useful websites about the mortgage process; and provide a checklist of issues that will aid you in effectively using the services of a loan broker.
