(XIII) Records protected under the common law governmental or "deliberativeprocess" privilege, if the material is so candid or personal that publicdisclosure is likely to stifle honest and frank discussion within thegovernment, unless the privilege has been waived. The general assembly herebyfinds and declares that in some circumstances, public disclosure of such recordsmay cause substantial injury to the public interest. Town of Telluride, Colorado: ARTICLE XIV: MISCELLANEOUS LEGAL PROVISIONS
No action for recovery of compensation for personal injury, death or property damage against the Town on account of its negligence shall be maintained unless written notice of the alleged time, place and cause of injury, death or property damage is given to the Town Clerk by the person injured, or an agent or attorney of that person, within thirty (30) days of the occurrence causing the injury, death or property damage. The notice given under the provisions of this Section shall not be deemed invalid or insufficient solely by reason of any inaccuracy in stating the time, place or cause of injury, if it is shown that there was not intent to mislead and that the Town in fact was not misled thereby. In terms of liability, because Tipsy Taxi is a crime prevention program and is operated under the authority of the Sheriff’s Office, the sheriff and deputy sheriff director are governed by the same rules of law as for the execution of any activity in the line of duty. The director makes every effort to run the program responsibly and to educate bartenders and taxi drivers on proper use. (See appendix for medical and underage drinking guidelines). In the second matter, Monkman failed to pay court-ordered sanctions and committed an act of moral turpitude. He filed a bankruptcy petition on behalf of a client, but in the petition stated that no previous action had been filed. In fact, the client had filed a previous petition and had been ordered by the bankruptcy court not to file another without obtaining a court order. Although the client said he told Monkman about previous filings, Monkman maintains he did not learn about prior cases until after the new petition was filed.
