Safe Mobility for Older Drivers
An ADA (Americans with Disabilities) suit was filed with the Department of Justice against the Wisconsin DMV by an out-of-state driver in a wheelchair who came to the DMV for a license transfer. The person did not have any restrictions on his out-of-state license, which is unusual; there should have been a restriction that he must only operate a vehicle with hand controls. So, the DMV required him to take a road test, and he thought that was discriminatory, because the person behind him in line was also out-of-state and did not have to take the road test (but also was not in a wheelchair). Wisconsin's practice was not considered discriminatory by the ADA (the driver did not win the suit). Nor did the ADA have any comments about how to improve their practices. A state can require a road test for the purpose of assuring highway safety. The Wisconsin Supreme Court has held that the operation of motor vehicles in Wisconsin is a privilege, not a right, and is subject to reasonable regulatio ... [Read More]

State legislation has not consistently established legalstandards for the minimum threshold needed to establish informed consent.   A number of states have taken actions toassure that the registry process is based on informed consent.   Extensive donation training programs for DMVpersonnel to improve the quality of information they provide to the public, increases their comfort level in discussing the topic of organ and tissuedonation, and may even have the effect of making them active proponents ofdonation.   Finally, to confirm donorswishes, two states send thank-you letters to registered donors soon after theyare entered into the registry. Some states have taken actions to increase the amount ofbackground information that individuals receive before they decide to becomeregistered donors.   For example, somestates present looped videos, pamphlets, and posters at DMV waiting rooms andlicensing offices in order to enhance the awareness among a captiveaudience.   DMV personnel m ... Birth Date and Legal Presence and True Full Name Requirements
It is critical that identification documents and systems be authentic and accurate in order to positively and uniquely identify each individual. The California legislature has declared the California driver license (DL) and identification (ID) card as the primary identification documents in this state. California state law requires that all applicants for an original California DL/ID card submit proof of legal presence in the United States (U.S.) as authorized under federal law. Your true full name, as shown on your legal presence document, will appear on your DL/ID card. These requirements help safeguard the accuracy and integrity of the documents issued by the Department of Motor Vehicles (DMV). ... [Read More]
