Citizens generally have the right to travel, live, and work where they please; however, the Government restricts these rights in some circumstances. The eastern states of Sabah and Sarawak have the right to control immigration and to require citizens from peninsular Malaysia and foreigners to present passports or national identity cards for entry. In 1998 the Court of Appeal ruled that Sabah and Sarawak, despite their autonomy, still were bound by the federal Constitution in all matters. Thus, the court voided Sabah's expulsion of an attorney from peninsular Malaysia who was involved in several lawsuits against the state government. In May the Federal Court overturned the Appeals Court decision and ruled that Sabah's exclusive control on immigration was provided for in the Constitution and could not be challenged. Personnel of all agencies and dependents 12 years of age and older should bring 10 to 12 1½” x 2” color photos for use at the post. The Administrative section requires photographs of the employee, spouse, and dependent children over age 12 in order to obtain residence visas, Foreign Office identity cards, and Malaysian drivers licenses. You can have the pictures taken at post, but to expedite matters, you should arrive with the necessary photos. The residence visa takes 2-3 weeks to process and currently must be renewed each year.
